These Terms & Conditions govern the use of the Pitstop Divers website and the purchase of products and services available through its online store.
By placing an order through the website, the customer confirms that they have read these Terms & Conditions and the other applicable policies and conditions referred to during the purchasing process.
Certain provisions apply exclusively to consumers, while others specifically govern relationships with professional Business (B2B) customers.
Any mandatory rights granted to consumers under applicable law remain unaffected.

Pitstop Divers operates from Malta and sells through its online store to consumers and professional customers within the European Union.
2. Definitions
For the purposes of these Terms & Conditions:
Consumer means a natural person purchasing mainly for purposes outside their trade, business, craft or professional activity.
Business / B2B Customer means a business, dive center, diving school, dive shop, independent instructor, professional or other operator purchasing within the scope of their commercial or professional activity.
An independent instructor or other self-employed professional may therefore qualify as a Business Customer even if they do not operate through an incorporated company, provided that the purchase is made in connection with their professional activity.
Customer means either a Consumer or a Business Customer, depending on the context.
Products includes equipment, components, spare parts, accessories and other goods sold through Pitstop Divers.
3. Use of the Website
The customer is responsible for the accuracy and completeness of the information provided during registration, checkout and any communication relating to an order.
The website must not be used fraudulently, unlawfully or in any manner that may compromise its operation, security or the rights of Pitstop Divers or third parties.
Pitstop Divers reserves the right to refuse or cancel orders where there are reasonable indications of fraud, abuse, obvious error or unlawful use of the website, subject to applicable law.
4. Product Information
Pitstop Divers takes reasonable steps to provide accurate and up-to-date product descriptions, images, technical specifications and information.
Images are primarily for illustrative purposes. Colours, packaging, labels and other non-essential details may differ from those shown on the website.
Technical specifications and packaging may also be modified or updated by manufacturers.
Where a technical characteristic is essential for a specific use, customers should verify it carefully before purchasing or contact Pitstop Divers for assistance.
5. Original and Compatible Aftermarket Spare Parts
Pitstop Divers sells diving equipment, components and spare parts from different manufacturers.
Where a spare part is an original component supplied by the manufacturer of the equipment, this may be indicated on the relevant product page.
Pitstop Divers may also sell compatible aftermarket spare parts and components manufactured by parties other than the original equipment manufacturer.
An aftermarket product must not be interpreted as an original manufacturer product unless expressly stated.
Where applicable, Pitstop Divers aims to clearly identify aftermarket products and provide available information regarding their intended use and compatibility.
Customers must verify that the selected component is suitable for the equipment and intended application. If there is any doubt regarding compatibility, we recommend requesting assistance before purchasing.
6. Safety-Critical Equipment and Components
Certain diving equipment and components perform functions directly related to user safety.
Installation, maintenance, servicing, adjustment or replacement of technical components on regulators, valves, high-pressure systems, compressors and other safety-critical equipment must be carried out by personnel with appropriate competence, training and, where required, authorization or qualification.
The sale of a spare part does not in itself represent a statement that the purchaser is qualified to install it or use it as part of a technical service operation.
Applicable manufacturer instructions, procedures, specifications and safety requirements must be followed.
Nothing in this section limits or excludes any liability of Pitstop Divers that cannot legally be limited or excluded.
7. Prices, VAT and Currency
All prices published on the Pitstop Divers website are expressed in Euro (€).
The way prices are displayed may vary depending on the type of customer and whether a Business (B2B) account has been activated by Pitstop Divers.
Consumer Customers
For customers purchasing through the website without a Business (B2B) account previously activated by Pitstop Divers, prices displayed for consumers are normally inclusive of VAT, where applicable.
Where, due to the type of product or another circumstance, a price is displayed excluding VAT, this will be clearly indicated on the relevant page or within the product description.
Before confirming an order, the customer will be able to review the applicable price, taxes and any additional charges, including shipping costs.
Business (B2B) Customers
For Business accounts activated by Pitstop Divers, reserved prices may be displayed excluding VAT, unless otherwise stated.
Any applicable VAT is determined according to the nature of the transaction, the customer’s country, tax status, information provided and applicable legislation.
Business status granted by Pitstop Divers does not, by itself, determine VAT exemption or non-application of VAT.
Business Customers are responsible for providing complete, accurate and up-to-date business and tax information.
Final Price
Before confirming a purchase, the customer will be able to review the order price, any applicable VAT, shipping charges and other applicable costs.
The amount shown at the final stage of checkout represents the total applicable to the order, subject to obvious errors or subsequent changes expressly accepted by the customer.
8. Registration and Activation of B2B Accounts
Registering an account on the website as a company, dive center, diving school, dive shop, instructor, professional or other operator does not automatically provide access to B2B pricing or commercial terms.
Similarly, entering a business name, company details or VAT Number during registration or checkout does not automatically activate B2B status.
Business information provided by the customer may nevertheless be used for the correct preparation of order documentation in accordance with the information supplied and applicable legislation.
First Purchase
A new professional customer whose account has not yet been approved and activated by Pitstop Divers as a Business (B2B) account will make purchases using the prices and commercial conditions normally available to non-B2B customers.
The presence of professional or business details within the account does not automatically alter this condition.
B2B Activation Request
Customers wishing to access professional pricing and commercial terms must first create an account on the website and then submit a request through the Customer Support Hub by selecting the B2B Activation category.
The request must refer to the account previously registered on the website.
Account Verification
Pitstop Divers will assess the request before activating B2B access.
Pitstop Divers may request information or documentation reasonably necessary to verify the applicant’s genuine commercial or professional activity.
Such information may include tax details, VAT Number, information about the professional activity or other relevant documentation.
Access to B2B pricing and commercial conditions is subject to approval by Pitstop Divers and does not arise automatically from account registration or submission of the request.
Once the account has been approved and activated, the customer will be able to access the professional prices and commercial conditions made available to their Business profile.
9. Product Availability
Product availability shown on the website is updated with reasonable care but may be subject to change.
Inventory discrepancies, subsequent unavailability or changes in availability from manufacturers, distributors or suppliers may occur.
If an ordered product is unavailable, Pitstop Divers will inform the customer and, where appropriate, offer an alternative solution, an agreed waiting period or a refund of the amount paid for the unavailable product.
10. Orders and Formation of the Contract
Submitting an order through the website constitutes an offer to purchase by the customer.
After placing an order, the customer will receive an electronic communication confirming receipt of the order. This communication confirms that the order has been received and does not necessarily constitute final acceptance of the order.
Pitstop Divers may verify product availability, order information and, where applicable, receipt of payment before finally confirming the order.
The sales contract is considered concluded when Pitstop Divers communicates acceptance of the order or confirms it for fulfilment or shipment.
Pitstop Divers may refuse an order for legitimate reasons, including product unavailability, inability to verify payment, obvious errors relating to price or product information, delivery restrictions or reasonable suspicions of fraud.
If Pitstop Divers does not accept an order for which payment has already been received, the amount due to the customer will be refunded, where possible, using the same payment method used for the purchase, unless otherwise agreed or technically prevented.
Nothing in this section limits any mandatory rights granted to consumers.
11. Obvious Pricing Errors
Pitstop Divers takes reasonable measures to ensure that published prices are correct.
If a product is displayed at a manifestly incorrect price due to a technical, administrative or typographical error, Pitstop Divers may contact the customer before final acceptance of the order.
The customer may be invited to confirm the purchase at the correct price, or the order may be cancelled and any amounts already paid refunded, subject to applicable law.
12. Payment Methods
The payment methods actually available are displayed during checkout.
Pitstop Divers accepts payments through major credit and debit cards supported by its payment provider, as well as Apple Pay and Google Pay where available and compatible with the customer’s device, browser and payment method.
Pitstop Divers also accepts bank transfers under the applicable conditions.

13. Payment Security
Electronic payments are processed through specialized payment service providers.
Pitstop Divers does not directly store complete card details where payments are processed through the payment provider.
Customers may be required to complete additional authentication procedures requested by their bank, payment network or payment provider.
14. B2B Payment Terms
Professional customers may make advance payments using the payment methods available during checkout.
Pitstop Divers may grant specific commercial terms to selected Business Customers, including deferred payment terms of 30, 60 or 90 days.
Such conditions must be expressly agreed and approved and do not constitute an automatic entitlement resulting from B2B status.
Pitstop Divers may also authorize payment on delivery by cheque for selected professional customers where this method has been agreed in advance.
15. Late B2B Payments
Amounts due from Business Customers must be paid by the agreed deadlines.
In the event of late payment, Pitstop Divers may apply statutory late-payment interest provided for under Maltese law governing commercial transactions, calculated in accordance with the applicable legal provisions.
Where permitted by law, Pitstop Divers may also claim legally recoverable debt recovery costs.
Pitstop Divers may suspend previously granted credit or deferred payment terms until the customer’s outstanding position has been fully regularized.
16. Unpaid or Returned Cheques
If a cheque used in a B2B transaction cannot be successfully cleared, the customer will be responsible for reasonable and documented costs directly arising from the management and recovery of the unpaid amount, within the limits permitted by law.
Pitstop Divers may require an alternative payment method and suspend any deferred payment arrangements until the outstanding balance has been fully settled.
17. Shipping and Delivery
Pitstop Divers ships to countries within the European Union according to the delivery methods available for each destination and product type.
Shipping costs, methods, limitations and other applicable conditions are described on the Shipping & Delivery page.
Heavy, bulky products or goods requiring specific transport arrangements may be subject to special shipping conditions.
Any delivery times indicated are estimates unless otherwise required by applicable law or expressly agreed.
18. Risk and Ownership of Products
For consumers, transfer of risk takes place in accordance with mandatory provisions of applicable law.
For Business Customers, unless otherwise agreed in writing, risk, delivery and transfer of ownership are governed by the conditions agreed for the specific transaction and applicable law.
To the extent permitted by law, Pitstop Divers may retain ownership of goods until full payment of the amount due has been received.
19. Consumer Right of Withdrawal
Where provided by the legislation governing distance sales, consumers have the right to withdraw from the contract within fourteen (14) days without giving a reason.
For the sale of goods, the withdrawal period normally begins on the day the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods, according to the rules applicable to the specific delivery arrangement.
To exercise the right of withdrawal, the consumer must clearly communicate their decision within the applicable period.

20. Return Costs Following Withdrawal
Unless otherwise provided by law or expressly stated by Pitstop Divers, the direct cost of returning a product following exercise of the right of withdrawal is borne by the consumer.
The product must be returned according to the instructions provided and adequately protected during transportation.
This provision does not apply to costs that, under applicable law, must be borne by Pitstop Divers where the product is defective, non-conforming or incorrectly supplied.
21. Exceptions to the Right of Withdrawal
The right of withdrawal may not apply in cases excluded by law, including, where applicable, goods made to the customer’s specifications or clearly personalized and other categories expressly excluded by legislation.
Any exclusion from the right of withdrawal will only be applied where the requirements provided by applicable law are satisfied.
22. Condition of Returned Products
Consumers may inspect and handle a product to the extent necessary to establish its nature, characteristics and functioning.
Where the product has been handled beyond what is necessary for such inspection, the consumer may be responsible for any resulting reduction in value to the extent provided by applicable law.

23. Incorrect, Damaged or Non-Conforming Products
If a customer receives an incorrect, damaged product or a product that may be defective or non-conforming, the customer must contact Pitstop Divers through the Customer Support Hub and provide the information necessary for assessment.
Pitstop Divers will review the request and communicate the appropriate instructions.
Consumers’ statutory rights relating to non-conforming goods remain unaffected.
24. Legal Guarantee for Consumers
Products sold to consumers benefit from the legal guarantees provided under applicable Maltese and European legislation.
Goods must conform to the sales contract and satisfy the requirements established by law.
The legal guarantee applies independently of any commercial warranty offered by the manufacturer.
Nothing in these Terms limits the mandatory statutory rights granted to consumers.
25. Manufacturer Commercial Warranties
Certain products may be accompanied by a commercial warranty provided by the manufacturer.
The duration, conditions, coverage and procedures of such warranties may vary depending on the manufacturer and product.
A manufacturer’s commercial warranty does not replace or limit the consumer’s statutory legal guarantee.
26. Warranty, Repairs and Technical Assistance
Pitstop Divers manages warranty, repair and technical assistance requests according to the nature of the product and the work required.
Pitstop Divers manages the case and determines the most appropriate technical service route.
Depending on the product and the nature of the service required, assistance may be handled directly or may require the involvement of the manufacturer, distributor, authorized service centre or another appropriate specialized technical facility.

27. Sending Products for Assistance or Diagnosis
Before sending any product for warranty assessment, diagnosis, repair, servicing or maintenance, the customer must open a request through the Customer Support Hub and wait for the relevant instructions.
Initial shipping costs for assistance or diagnosis, products subsequently confirmed as covered by warranty and services outside warranty are treated as separate circumstances and are handled according to the Warranty & Repairs page and the customer’s applicable statutory rights.
Where a product is confirmed as covered by a legal or applicable warranty, costs and service will be handled according to the customer’s rights and applicable law.
For out-of-warranty work, Pitstop Divers may carry out or arrange a diagnosis and provide a quotation before proceeding with the repair.
28. Spare Part Compatibility
Customers must carefully verify the compatibility of a spare part with the equipment on which they intend to use it.
Where available, brand, model, version, serial number and other technical information should be checked before purchase.
Pitstop Divers provides assistance with spare-part identification and compatibility based on the information available.
Customers are responsible for providing complete and accurate information about the equipment concerned.
Where Pitstop Divers expressly confirms compatibility on the basis of information provided by the customer, that assessment refers to the information available at the time of the request.
29. Installation of Spare Parts
Certain spare parts may be installed directly by the user where this is permitted by the manufacturer and can be done safely.
Components requiring technical disassembly, adjustment, calibration, pressure testing or work on safety-critical systems must be installed, inspected and, where necessary, tested by appropriately qualified personnel.
Customers must follow applicable manufacturer manuals, procedures, maintenance intervals and technical requirements.
30. Compressors, Filling Stations and Professional Equipment
Compressors, filling stations, high-pressure systems and other professional equipment may be subject to specific technical, logistical, installation, maintenance and transport requirements.
Where necessary, Pitstop Divers will communicate the applicable conditions before confirmation of the order or service.
Installation, use and maintenance of high-pressure systems must comply with manufacturer instructions, applicable legislation and, where required, be carried out by appropriately qualified personnel.
31. Business (B2B) Customers
Purchases made by professional customers within the scope of their commercial or professional activity do not automatically benefit from provisions specifically intended for consumers.
B2B conditions may be supplemented by quotations, offers, commercial agreements or specific conditions agreed in writing.
Where these Terms conflict with specific B2B commercial conditions agreed in writing for a particular transaction, the specifically agreed conditions prevail to the extent applicable, subject to mandatory legal provisions.
B2B account access may be suspended or withdrawn where the requirements on which approval was based are no longer met, false or inaccurate information has been provided, or agreed commercial conditions have not been respected.
32. Limitation of Liability
Pitstop Divers does not exclude or limit any liability that cannot legally be excluded or limited.
In B2B relationships and to the extent permitted by law, Pitstop Divers will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time the contract was concluded.
Nothing in these Terms limits liability for death or personal injury where such liability cannot lawfully be excluded, defective products, fraud, wilful misconduct or any other liability that applicable law does not permit to be excluded or limited.
33. Professional Use and Operational Responsibility
Professional customers are responsible for the use, installation, maintenance and management of equipment purchased for their business or professional activities in accordance with applicable law, manufacturer instructions and relevant professional standards.
This provision does not limit any responsibility of Pitstop Divers relating to the conformity, safety, description or supply of products where such responsibility is imposed by law.
34. Force Majeure
To the extent permitted by law, Pitstop Divers will not be responsible for delays or failure to perform obligations caused by events reasonably beyond its control, including major transport disruptions, natural events, conflicts, external strikes, governmental measures, emergencies or significant disruption to essential networks and services.
Pitstop Divers will take reasonable measures to limit the effects of such events and resume performance of its obligations where possible.
Mandatory consumer rights remain unaffected.
35. Intellectual Property
Unless otherwise stated, original content, text, graphic elements, structure and materials published on the Pitstop Divers website are protected by applicable intellectual property laws.
Trademarks, logos, images and other materials belonging to manufacturers or third parties remain the property of their respective owners.
Their use on the website does not transfer any ownership rights to Pitstop Divers.
36. Privacy and Data Protection
Personal data is processed in accordance with applicable data protection legislation.

37. Communications and Customer Support
Customers may use the Pitstop Divers Customer Support Hub for enquiries relating to orders, shipping, returns, refunds, warranties, repairs, technical assistance or B2B account activation.
The ticket system helps organize communications and route requests to the appropriate support category.

38. Complaints and Alternative Dispute Resolution
In the event of a problem relating to a purchase, Pitstop Divers encourages customers to contact its customer support service first so that the matter can be assessed and, where possible, resolved directly.
Consumers may use the remedies and complaint procedures available under applicable Maltese and European legislation.
Where applicable, a dispute between Pitstop Divers and a consumer may also be submitted to an Alternative Dispute Resolution (ADR) procedure through a competent body for the out-of-court resolution of disputes.
In Malta, the Malta Competition and Consumer Affairs Authority (MCCAA), through its ADR system, provides procedures for the alternative resolution of certain disputes between consumers and traders, including, where applicable, cross-border disputes within the European Union.
Participation in an ADR procedure is subject to the conditions established by applicable legislation and the relevant procedure and does not limit the right of either party to bring proceedings before the competent courts where permitted by law.
39. Governing Law
These Terms & Conditions are governed by Maltese law.
For consumers residing in another Member State of the European Union, this choice of law does not deprive the consumer of the protection provided by mandatory provisions of the law that would otherwise apply in the absence of such a choice.
40. Jurisdiction
For relationships with Business Customers, unless otherwise agreed in writing and to the extent permitted by law, disputes will be subject to the jurisdiction of the competent courts of Malta.
For consumers, mandatory rules governing jurisdiction under applicable Maltese and European law shall apply.
41. Changes to These Terms & Conditions
Pitstop Divers may update these Terms & Conditions to reflect changes in legislation, operations, commercial practices or services offered.
The conditions applicable to an order are those in force at the time the relevant contract is concluded, unless changes are required by law.
The date of the latest update is shown at the beginning of this page.
42. Severability
If any provision of these Terms is found to be invalid, ineffective or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
43. Entire Agreement
These Terms, together with the conditions specifically referred to during the purchasing process and any applicable policies, form the contractual framework governing purchases made through Pitstop Divers.
For Business Customers, specific commercial conditions agreed in writing may supplement or modify these Terms to the extent stated in the relevant agreement.
